Originality in joint authorship

Started Sep. 2022

Theme

The work and the author define copyright law and are simultaneously defined by it. In the EU both the concept of the work and of the author are commonly interpreted in a rigid manner concentrated on the economic outcomes. At the same time contemporary conceptual art is more and more dependent on authorial acknowledgement and the new forms of inclusive, open-ended works arising thanks to the internet often do not fit in the copyright framework. For the law to retain its legitimacy, a more practice oriented interpretation of the legal definition of originality is essential. The interpretation of originality of a work has a significant impact on the understanding of authorship.

Method

Legal research with certain socio-legal and empirical aspects, including interviews and presentations.
